Terms of Service

By adding the Bot to any Discord server, accessing the Portal, or interacting with any feature of the Services, you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Service ("Terms") and our Privacy Policy, which is incorporated herein by reference.

If you are a Server Administrator accepting these Terms on behalf of an organisation, you represent and warrant that you have the authority to bind that organisation to these Terms, and all references to "you" shall apply to that organisation.

If you do not accept these Terms in their entirety, you must immediately cease all use of the Services, remove the Bot from any servers you control, and log out of the Portal.

You must meet all of the following requirements to use the Services:

• ▸You must be at least 13 years of age, or the minimum age of digital consent applicable in your jurisdiction, whichever is higher.
• ▸You must hold a valid Discord account in good standing and comply fully with Discord's Terms of Service and Community Guidelines at all times.
• ▸Server Administrators who configure TikTok integration must hold a valid TikTok account and comply with TikTok's Terms of Service.
• ▸You must not be prohibited from receiving services under the laws of your country of residence.
• ▸You must not have previously had your access to J.A.D.E. suspended or terminated for violation of these Terms.

Subject to your compliance with these Terms, J.A.D.E. grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Services for the following purposes:

• ▸Configuring and operating the Bot within Discord servers you own or administer, for the benefit of that server's community.
• ▸Accessing the Portal to manage Bot configuration, view analytics, and perform administrative tasks for servers where you hold appropriate permissions.
• ▸Using TikTok content notification features to relay publicly available content from TikTok creator accounts to Discord channels, strictly in accordance with TikTok's API Terms of Service and Platform Policies.
• ▸Using economy, leveling, moderation, and other feature modules to manage and enrich your Discord community experience.

You expressly agree that you will not, and will not permit any third party to:

• ✕Use the Services to transmit, store, distribute, or facilitate content that is unlawful, harassing, defamatory, obscene, abusive, threatening, harmful, or otherwise objectionable.
• ✕Attempt to gain unauthorised access to J.A.D.E. systems, the Portal, databases, or any related infrastructure.
• ✕Conduct denial-of-service attacks, distributed denial-of-service attacks, or any action that disrupts, degrades, or overloads the Services or infrastructure.
• ✕Use automated scripts, scrapers, bots, or other tools to make bulk requests to the Portal or APIs beyond normal operational use.
• ✕Reverse engineer, decompile, disassemble, or attempt to extract source code from the Bot or Portal software.
• ✕Use the TikTok integration features to access, display, redistribute, or reproduce TikTok content in any manner that violates TikTok's Terms of Service, API Terms of Service, or Platform Policy.
• ✕Represent or imply that J.A.D.E. is affiliated with, endorsed by, or sponsored by TikTok, Discord, or any other third party.
• ✕Use the Services in connection with any unlawful activity, including but not limited to fraud, money laundering, or intellectual property infringement.
• ✕Violate Discord's Developer Terms of Service or Community Guidelines through use of the Bot.
• ✕Circumvent, disable, or interfere with security features of the Services, including authentication or access control mechanisms.
• ✕Resell, sublicense, or otherwise commercialise access to the Services without express written permission.

J.A.D.E.'s TikTok integration operates under and is subject to the TikTok for Developers Terms of Service and TikTok API Terms of Service. By enabling TikTok features within J.A.D.E., you acknowledge and agree to the following:

• ▸You represent that any TikTok account you monitor through J.A.D.E. is either your own or that you have obtained all necessary permissions from the account holder to receive and redistribute public content notifications in Discord.
• ▸You will not use J.A.D.E.'s TikTok integration to collect, store, analyse, or redistribute TikTok data in bulk beyond the notification relay functionality described herein.
• ▸You will not use J.A.D.E. to harvest TikTok user data for commercial purposes, advertising targeting, or resale.
• ▸J.A.D.E. may be required to modify or discontinue TikTok integration features at any time if TikTok's API policies or terms change. No compensation is owed to you in such an event.
• ▸You acknowledge that TikTok content displayed through J.A.D.E. notifications remains the intellectual property of its respective creators and TikTok. J.A.D.E. does not claim ownership over any TikTok content.

Your data: J.A.D.E. does not claim ownership over any server configuration, content, or data you create or submit through the Services. You retain all rights to your server data and configurations.

Licence you grant: By using the Services, you grant J.A.D.E. a limited, royalty-free, non-exclusive licence to process, store, and transmit your configuration data and server identifiers solely to the extent necessary to provide the Services to you.

J.A.D.E. intellectual property: The Bot software, Portal interface, documentation, and all associated J.A.D.E. branding are the intellectual property of the J.A.D.E. development team. You may not copy, modify, distribute, sell, or exploit any part of the Services without express written permission.

Third-party content: Content sourced from TikTok, RSS feeds, or other third-party sources displayed through the Services remains the intellectual property of the respective rights holders. J.A.D.E. claims no ownership over third-party content.

To the fullest extent permitted by applicable law, J.A.D.E. expressly disclaims all warranties, including but not limited to:

• —Warranties of merchantability — that the Services are of satisfactory quality or fit for any particular purpose.
• —Warranties of uninterrupted service — J.A.D.E. does not guarantee that the Services will be available at all times, free from errors, or immune to downtime caused by maintenance, hardware failure, or third-party service disruption.
• —Warranties regarding third-party services — J.A.D.E. has no control over Discord, TikTok, RSS feed providers, or other external platforms. Changes, outages, or policy shifts by these platforms may affect the Services without notice.
• —Accuracy of notifications — While J.A.D.E. makes commercially reasonable efforts to deliver timely and accurate TikTok notifications, delays, missed events, or duplicate events may occur due to API rate limits or third-party changes.

This limitation applies regardless of the basis of liability (contract, tort, negligence, strict liability, or otherwise) and includes but is not limited to damages arising from:

• —Loss of data, revenue, profit, or business opportunity.
• —Service outages, downtime, or interruption.
• —Unauthorised access to or alteration of your data by third parties.
• —Missed or delayed TikTok content notifications.
• —Actions or omissions of Discord, TikTok, or any other third-party service integrated with J.A.D.E.

Where applicable law does not permit the exclusion of certain warranties or the limitation or exclusion of liability for certain types of damages, J.A.D.E.'s liability shall be limited to the greatest extent permitted by law.

You agree to defend, indemnify, and hold harmless J.A.D.E., its developers, contributors, and affiliates from and against any claims, liabilities, damages, losses, and expenses — including reasonable legal fees — arising out of or in connection with:

• ▸Your use of or inability to use the Services.
• ▸Your violation of these Terms.
• ▸Your violation of any third-party rights, including Discord's or TikTok's Terms of Service.
• ▸Any content you configure, distribute, or facilitate through the Services.
• ▸Any misuse of the TikTok integration features contrary to TikTok's API policies.

By J.A.D.E.: We reserve the right to suspend or terminate your access to all or any part of the Services, with or without notice, if we reasonably believe you have violated these Terms, Discord's terms, TikTok's API Terms of Service, or any applicable law. No refund or compensation is owed upon termination.

By you: You may terminate your use of the Services at any time by removing the Bot from all servers you control and ceasing use of the Portal. You may request deletion of data associated with your servers as described in the Privacy Policy.

Effect of termination: Upon termination, your licence to use the Services ceases immediately. Sections 7, 8, 9, 10, 12, and 14 of these Terms shall survive termination.

These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.

Any dispute arising out of or in connection with these Terms that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where mandatory local consumer protection laws in your jurisdiction require otherwise.

Nothing in this section limits your rights as a consumer under the law of the country in which you are resident.

We may update these Terms from time to time. Where changes are material, we will make reasonable efforts to provide notice — such as a notification through the Portal or the J.A.D.E. support channel — prior to the new terms taking effect.

Your continued use of the Services after any revision constitutes your acceptance of the updated Terms. If you do not agree to revised Terms, you must cease using the Services.

The "Last revised" date at the top of this document indicates when these Terms were most recently updated.
